Limitation Applied to Transfer of Vicarious Liability

In a recent NSW Court of Appeal decision, an important qualification was applied when assessing whether there had been the requisite transfer of employment. As a result, in certain circumstances, it may now be harder for an employer to transfer vicarious liability to the host.
